Subscription Terms and Conditions

The website (hereinafter referred to as " OZERTY ") is published at https://ozerty-turkiye.com.

ARTICLE 1: Definitions

In order to facilitate the readability of these Subscription Terms and Conditions, the following terms will always have the meaning and scope set out in this clause.

Terms and Conditions


This refers to the subscription terms and conditions.


User Account

 


It refers to the personal account of the User, which must be registered in order to use the Subscription service and where the User can review and manage information about himself/herself, such as his/her personal data, shopping history on the site, delivery addresses, etc., by connecting to the site with his/her credentials.


Identity Information


Refers to the username and password chosen by the user to access the service.


Record


Refers to the online registration procedure that the User must complete in order to use all or part of the service; this procedure results in the creation of credentials and a User Account.


Service fees


Refers to the costs of the service to which the user subscribes, which may include, but are not limited to, items such as delivery costs, product customization costs, etc.


Service


It refers to the service offered by OZERTY to make one or more subscriptions through the site.


Site


Refers to https://ozerty-turkiye.com, which allows you to review current consumer products and to purchase and receive these products.


User


It refers to any adult or legal entity that accesses the Site and subscribes to the Service.


Visitor


Refers to any natural or legal person who accesses the site for review purposes only and does not have a User Account.


Subscription


Refers to the subscription program offered by Ozerty.


Subscriber


Refers to any user who subscribes to the Service.


Ozerty No Limit


Refers to the name of the subscription program offered by Ozerty.

 

ARTICLE 2: Acceptance of terms and conditions of use

These Terms and Conditions govern Users’ access to the Subscription Service (Ozerty No Limit) offered on the Site. Subscribing to the Service means acceptance of the Terms and Conditions of Use of the Service described herein.

Registration and/or subscription to free or paid Services implies the User's unconditional acceptance of the provisions of the Terms and Conditions, expressly acknowledging that he has previously read, understood and accepted them.

Subscription occurs when the User ticks a checkbox when making a purchase for the first time ("Subscribe to Ozerty No Limit").

The applicable Terms and Conditions are always available and freely accessible on the Site. OZERTY reserves the right to change the Terms and Conditions at any time, subject to specific technical, economic, legal or commercial constraints, such as the launch of new services.

Users will be notified of any changes to the Terms and Conditions within a reasonable period of time. Where relevant, Users will be notified of the new applicable Terms and Conditions upon entry and will be required to accept them in order to continue to enjoy the Services.

Otherwise, the User may unsubscribe; such unsubscription shall be effective upon receipt of the User's last order placed before the change in the Terms and Conditions.

Any deviation from the Terms and Conditions, in order to be valid and binding for OZERTY, must be made in a written document signed by OZERTY and the User, expressly referencing the Terms and Conditions.

OZERTY reserves the right to suspend any subscription or terminate its services immediately if the User violates any of the Terms and Conditions.

Any information sent electronically with a hard copy of the Terms and Conditions will be admissible in any legal process relating to the enforcement of these Terms and Conditions in the same manner and under the same conditions as any other document written and maintained in paper format.

OZERTY's failure at any time to exercise an authority granted by these Terms and Conditions or to demand the performance of any term of the contract arising from these Terms and Conditions shall not be interpreted as a waiver, express or implied, of its right to change the contract or to exercise this authority in the future under any circumstances.

If the Terms and Conditions specified in this agreement are not accepted, the User must stop using the service he/she has subscribed to on the site.

ARTICLE 3: Subscription

By subscribing to Ozerty No Limit subscription, subscriber agrees to pay 10₺ + tax per day (1232₺ + tax paid every 4 months). In return, subscriber receives 40% discount on website (can be combined with any discounted price on website), Free Standard Shipping for year and special priority customer service. Subscribers will benefit from these benefits as long as the subscription is active. Once the subscription ends, the benefits are lost and will not be valid until the subscription is reactivated.

ARTICLE 4 : Free trial

When you subscribe to the service, subscribers will have free use of the total service for 6 (six) days, after which time the service fee will be charged unless cancellation of the subscription is explicitly requested.

ARTICLE 5: Payment

At the end of the free trial period, ₺1232+tax will be deducted from the preferred payment method. In the event of a delay in accepting the payment, a payment error or any other situation that prevents the payment from being processed, the subscription will immediately terminate and all benefits will be lost.

    ARTICLE 6: Cancellation

    Subscription is a non-binding service. It can be terminated at any time. The subscriber can request the cancellation of the subscription by sending an e-mail to destek@ozerty-turkiye.com.

    If less than 30 days have passed between the last payment and the cancellation request and the subscriber has not used any of their benefits, the full last payment may be requested.

    Once any benefit is used within the first 30 days, the first month will be considered consumed and cannot be refunded; only the remaining time can be refunded.

    After the first 30 days, the subscriber can request a refund for the remaining period of the subscription. Any month started will be considered a paid month and cannot be refunded. For example, if the subscriber wants to stop their subscription after 33 days, they can request a refund of ₺10 x 87 days: ₺870+tax.

    Once a cancellation request is received via email, any new payments made after this date will be automatically refunded.

    All refunds will be made within a maximum of 14 business days.

      ARTICLE 7: Changes to Terms and Conditions

      OZERTY reserves the right to change these terms at any time. All changes will be notified to the subscriber at least 30 days before the change comes into effect. If the subscriber does not accept the new Terms and Conditions, he/she can request the cancellation of the subscription by following the procedure stated above.

      ARTICLE 8: Limits of liability

      The Service is provided "as is" and "as available" without any warranties.

      OZERTY cannot be held responsible for the unavailability of a product or if the purchased product does not meet the subscriber's expectations.

      ARTICLE 9: Personal data

      By subscribing to Ozerty No Limit, the subscriber herein accept OZERTY's usage of the personal data in accordance with the Privacy policy of the website.

      ARTICLE 10: Applicable right

      These Terms and Conditions are governed by Turkish law.

      Any complaint must be sent to the following address within a maximum of thirty (30) days after the performance or scheduled date of performance of the Service subscribed to by the subscriber:

      If an amicable solution cannot be reached between the parties, the Turkish courts will examine the situation as the sole authority.
